These Product Terms of Service ("Product Terms") govern your use of DK1.AI products and services (collectively, "Products"). These Product Terms supplement our Terms of Use and Privacy Policy. By accessing or using any Product, you agree to these Product Terms.
Access and Accounts
Access to Products is granted through access codes issued by DK1.AI. Access codes generate single-use, time-limited tokens. You are responsible for maintaining the confidentiality of your access credentials. DK1.AI may revoke access at any time, with or without cause.
Your Data
You retain all ownership rights in the data you upload or create within Products ("Your Data"). By using the Products, you grant DK1.AI a limited, non-exclusive license to process Your Data solely for the purpose of delivering the Products and related services. We will not use Your Data for any other purpose without your consent.
AI Processing
Products use artificial intelligence models provided by third parties (including Anthropic and OpenAI) to power features such as signal extraction, scoring, recommendation generation, content analysis, and draft creation. By using the Products, you acknowledge that:
- Your Data may be sent to AI model providers for processing in the course of delivering Product features.
- DK1.AI does not use Your Data to train general-purpose AI models.
- AI-generated outputs are assistive and informational. They should not be treated as authoritative advice. You are responsible for reviewing and validating all AI outputs before acting on them.
- AI outputs may contain errors, omissions, or inaccuracies.
Acceptable Use
You agree not to:
- Upload illegal, harmful, or offensive content.
- Upload personally identifiable information of third parties without their consent or a lawful basis.
- Upload data you do not have the right to use or that violates third-party intellectual property rights.
- Attempt to reverse-engineer, disassemble, or circumvent security features of the Products.
- Use the Products to develop competing products or services.
- Share access codes or credentials with unauthorized parties.
Confidentiality
DK1.AI treats Your Data as confidential. We will not disclose Your Data to third parties except: (a) to sub-processors necessary to deliver the Products (listed on our Data Processing page), (b) as required by law, or (c) with your prior consent.
Data Handling and Deletion
Your Data is processed in accordance with our Privacy Policy. Product data is retained for the duration of your access plus 30 days. You may request deletion of Your Data at any time by contacting privacy@dk1.ai. Upon termination, DK1.AI will provide a reasonable window for you to export Your Data before deletion.
Disclaimer of Warranties
Products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DK1.AI does not warrant that Products will be uninterrupted, error-free, or that AI outputs will be accurate or complete.
Limitation of Liability
To the fullest extent permitted by law, DK1.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Products, including but not limited to damages resulting from reliance on AI outputs, loss of data, or business interruption. Our total aggregate liability for any claim arising from your use of the Products shall not exceed the amount you paid DK1.AI for the Products in the twelve months preceding the claim, or one hundred dollars (US $100), whichever is greater.
Indemnification
You agree to indemnify and hold harmless DK1.AI from any claims, damages, losses, and expenses (including attorneys' fees) arising from: (a) Your Data, (b) your use of the Products, (c) your violation of these Product Terms, or (d) your violation of any third-party rights.
Termination
Either party may terminate access to the Products at any time. DK1.AI may suspend or terminate your access immediately if you violate these Product Terms. Upon termination, your right to access the Products ceases. Sections regarding data ownership, confidentiality, limitation of liability, indemnification, and governing law survive termination.
Governing Law
These Product Terms are governed by the laws of the State of Maryland, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Maryland.
Severability
If any provision of these Product Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
Changes
We may update these Product Terms from time to time. Material changes will be communicated through the Products or by updating the date at the top of this page. Continued use of the Products after changes constitutes acceptance.
